Medicare / Medicaid Law
People are often confused about the differences between
Medicare & Medicaid.
Medicare is a government health program, available to everyone over the age of 65 or on Social Security Disability for two years. Eligibility for Medicare is not tied to individual need. Rather, it is an entitlement; you are entitled to it because you or your spouse paid for it through Social Security taxes.
Medicaid, on the other hand, is a major federal government social welfare program that is based on financial need, primarily for low income individuals. Although you may qualify and receive coverage from both Medicare and Medicaid, there are separate eligibility requirements for each program; being eligible for one program does not necessarily mean you are eligible for the other.
Military Law
All persons serving in the Armed Forces of the United States are subject to military law at all times. Military lawyers represent members of the armed services in matters that are in the jurisdiction of a military proceeding including court martial and other military law disciplinary proceedings.
Nursing Home Abuse
Nursing Home abuse is a part of general health care negligence as
a whole. Although nursing homes or long-term care facilities are normally a very positive place for their patients, they can also be a place of negligent health care. Some factors that make up nursing home abuse are poorly qualified and inadequately trained staff, inadequate numbers of staff, the isolation of residents, and the repression of patients complaints. These are very serious issues and if you, or a loved one has been a victim, contact a New York City Injury attorney specializing in this field immediately.
Patent Law
Patents grant an inventor the right to exclude others from producing or using the inventor’s discovery or invention for a limited period of time, usually 20 years from the date on which the application for the patent was filed in the United States. Patents are a form of intellectual property that protect new and useful machines, articles, substances, or processes through exclusive rights granted by the federal government to their inventors. To receive an invention patent, the inventor must apply to the federal government and, if the invention patent is granted, the government will publish a full description for the invention and its use in the patent disclosure.
Personal Injury Law
Accident and Personal Injury law deals strictly with civil wrong doings. These civil wrongs are under the category of tort law, as opposed to criminal law. Personal Injury law plays a vital role in individual legal rights and balancing the power between individuals and corporations. “Personal Injury” cases are legal disputes that arise when one person suffers harm from an accident or injury and someone else might be legally responsible for that harm, or damages personal property and that person has to pay for the damage done. Under a legal rule known as the “statute of limitations,” any lawsuit arising from an accident or injury must be filed within a certain time limit or the injured person’s legal claim will be barred and his or her right to sue will be lost forever.
